User Agreement


Before using this website, we strongly advise you to read this User Agreement carefully!

Understanding:  Since Gopoco.com is Community Oriented, we do NOT accept listings posted by PrimeSellers, Chains, Wholesalers and/or large commercial institutions. Exceptions are made for not for profit organizations and community oriented institutions.
In addition, we will not carry personals or dating oriented listings. We will also carefully scrutinize the sale of animals. 

Your 'UserName' identifies you; your 'Postal/Zip Code' defines your geographics; and your 'email address' is Gopoco Admin's means of contacting and informing you on the status of your listings and messages.

Conditions

In order for Gopoco.com to work efficiently and run trouble free, every applicant must agree to the terms of this User Agreement in which 'Gopoco' and 'the Site' is synonymous with 'Jansite Enterprises Inc.', the company that owns and operates 'the Site'; the 'Member' is synonymous with 'User'.

Membership

In order to become a free 'Member' of the Internet 'Site' known as 'Gopoco.com', the prospective 'User' certifies at the time of registration that he/she has read, fully understands, and agrees to the following terms:

  1. Each Member shall have his or her own registration.
  2. Member registration is not transferable.
  3. Pseudonyms are not allowed. A Member must at all times use his/her registered Username to identify him/herself.
  4. Gopoco Membership and the Site's use is voluntary, free, and at the Member's own risk.
  5. Except for personal contact information that you choose to reveal publicly in your listings and postings (Username, Email Address, Postal/Zip Code, Gopoco will keep all other particulars relating to your membership in the strictest confidence. (See Privacy Policy)

Restrictions

Since Gopoco's purpose is to preserve and enhance the common good, one Member at a time, by making buying, selling, trading, donating, or promoting goods and services available as indicated, the Member agrees that in his/her usage of the Site, he/she will:

  1. Not use Gopoco as a dating service.
  2. Not violate any law on the Gopoco Site of the country or political jurisdiction (State, Province,Territory etc.) in which he/she resides.
  3. Not post abusive, sexual, violent, false, misleading or other similar material generally considered offensive.
  4. Not use Gopoco to distribute chain letters, advance pyramid schemes, promote hatred or disseminate religion-specific material.
  5. Not implement any measures that might negatively affect the use of the Gopoco Site by others, including the creation of measures designed to interfere with, restrict access to, or tamper with other Members' postings.
  6. Not distribute computer viruses of any kind.
  7. Not post any listings that could be considered of an intimate or personal nature.
  8. Not post multiple postings of a single item, even if that item has multiple components, it shall have a clearly defined, single posting.
  9. Listings are dispayed for 30 days. If the member has allowed for email contact, a five day advance email notice is sent automatically notifying the Member their listing is about to terminate. A link is supplied to renew the Listing.
  10. Otherwise, the Member is responsible for deleting his/her posting; either upon a decision made prior to having committed to selling the item(s) or after having sold the item(s). Failure to do so, within two days (48 hrs) after a completed transaction between Members, may lead to a point loss of a Member's record, should a report by another Member prove the item continues to linger longer than the 2 day period.
  11. Gopoco eliminates a listing, should a listing be flagged three times.

 Response To Abuse

Gopoco reserves the right to remove any content it deems unsuitable, in violation of any law, or the personal rights of any other Member. Such a decision by Gopoco shall not be subject to review or adjudication by any third party.

Any Member confronting listed material he/she deems offensive may 'flag' that listing. Three such 'flags,' posted by three different Members, will result in the offending posting being eliminated. Should a Member, having placed such a flagged item, post a second item deemed offensive and, where that item has also been flagged by three different Members, the membership of the Member having listed such a second item will be automatically revoked, with no questions asked and no explanation given.

Postings of child pornography, and those that promote hatred or encourage violence will result in the listing being reported to a Police Agency associated with Interpol for investigation.

Copyright

Since Gopoco.com functions as an open public market, the Member agrees to grant Gopoco.com a non-exclusive, royalty-free, irrevocable global right in perpetuity to sub-license, exercise the copyright, publicize and database all posted content. Without these rights, your Member listings cannot be displayed. (These rights do NOT include any other entitlement, including ownership)

If at any time a Member feels his/her rights have been violated, he/she may send an email to Gopoco's Customer Service, or, if the Member deems the matter serious, send a registered letter to the address shown below.

Liability

While Gopoco will do its utmost to at all times protect its Members, it will not be liable, or held responsible for so-called "Acts of God" — events that are beyond the reasonable control of the Site or its parent company. These include computer viruses, interventions by outside third-party 'hackers,' equipment failures, power interruptions and any and all interventions of a like nature.

The Member agrees not to hold Gopoco.com, or its parent company, their staff, management, agents or shareholders responsible for (a) the responses you may get to your listings, (b) other Member listings, (c) the accuracy of your or other Members' listings, their wording or method of expression, or (d) the quality, safety, or legality of any listed goods or services, or any other, to the Member unsatisfactory communication and or method of payment the Member may have encountered.

Gopoco.com may need to shut down temporarily for maintenance or updating. When that need arises, it will post ample warning. It shall not be held responsible for such shutdowns or any discontinuous or insecure access to its Site.

Gopoco.com expressly disclaims all warranties, representations and conditions, expressed or implied, including those of quality, durability, saleability, or applicable purpose of any product or service posted on the Site.

Gopoco.com is not liable for loss of money, profit, goodwill, reputation, or any direct, indirect, or consequential damage arising from a Member's use of the Site.

Should Gopoco.com and/or any person(s) officially associated with the Site be found liable in any matter relating to this Agreement, Gopoco's liability shall not be greater than the sum paid to Gopoco.com by the complaining Member/ Advertiser, if any, within the prior twelve months of the dated action leading to the liability.

Gopoco.com will not take any liability for unauthorized use of the site by those under 18 years of age.

Conclusion

Gopoco may, at its discretion, at any time and without prior notice, alter, add to, nullify, or update these terms. Otherwise, these terms constitute the entire Agreement between Gopoco.com and its Member. While Gopoco may not enforce a provision, that does not waive Gopoco's right to do so later. If a court should strike down any of these terms, the remaining shall nonetheless survive and continue in full force.

This Agreement is governed by the laws of Canada, and the Province of British Columbia.

Correspondence considered of a legal nature must be clearly marked "Re: Gopoco.com" and sent by registered mail to:
